Conditions of use for the Rack Railway and Funiculars of Montserrat services

1.- To travel on the Rack Railway or the Funiculars of Montserrat of Ferrocarrils de la Generalitat de Catalunya, FGC, it is necessary to purchase and validate an appropriate ticket for the journey before boarding the train or funiculars, or accessing the interior areas delimited by the validating machines or informative signage.

2.- The ticket must be kept until leaving the station to show it when requested by company personnel at any point during the journey and to validate it upon exit at stations with exit validators.

3.- The ticket will not be valid if it has undergone any alteration or manipulation or, where applicable, if it is not accompanied by the identification card or does not correspond to the specific usage conditions.

4.- Users have the right to use the ticket that suits them best—single ticket, multi-journey card, etc.—for their travels and the obligation to inform themselves, before purchasing it, of the characteristics of each ticket. The plea of ignorance does not exempt the traveler from responsibility.

5.- In order to purchase tickets, FGC's public users have adequate information about the journey in information displays and on FGC's website.

6.- The Rack Railway and the Funiculars of Montserrat are tourist transport with specific tickets and fares, and the tickets and conditions provided by the Metropolitan Transport Authority (ATM) are not valid.

7.- The ticket, purchased before use, will be valid until there is a fare change and, in any case, until the date determined as valid for travel. From that moment on, FGC will not refund or exchange it.

8.- To access the transport services, the user must have a valid ticket in accordance with the applicable conditions at all times.

9.- In the Funiculars of Montserrat, tickets are valid for one day from the moment of purchase. In the Rack Railway of Montserrat, tickets will be valid for the day of validation. Round-trip tickets can be used up to 7 days after the first validation.

10.- It is considered that the user misuses the service in the following cases:

a) The ticket has not been validated before traveling or accessing the areas specified in point 1 of these conditions of use. 

b) The user does not have the ticket or cannot show it when asked. 

c) The ticket has expired, i.e., when used outside the temporal validity period established in the standard contract or special fares. 

d) It is a reduced fare ticket, and the traveller cannot prove the right to obtain it

e) It is a personalized ticket not in the user's name

f) Traveling with a transport pass that is not valid for the specific characteristics of the journey or the traveller.

11.- Misuse of the transport service means that any intervention by authorized FGC personnel may result in the immediate blocking and/or withdrawal of a ticket contained in the medium, whether it is a physical medium or a mobile medium, without prejudice to any legal responsibilities that may arise and the disqualification for future reissues. A ticket may be blocked in the situation it is used if it is not valid for the user. A personalized transport pass is not considered valid if not accompanied by the ID or another official identification document proving that the pass corresponds to the user, and a discounted transport pass also requires the accompaniment of the official documentation proving the user.

12.- In case the user carries a ticket with signs of manipulation or forgery, it must be confiscated. Subsequently, the person will be instructed to leave the train or the premises.

13.- Possession of a valid ticket guarantees the provision of transport but does not guarantee the occupancy of a seat on the train. If the user does not find a free seat, they can choose to stand on the platforms or interior aisles of the cars or delay their journey until the next train with available seating. Under no circumstances can users sit on the platforms.

14.- Children under 4 years old can travel for free if they do not occupy a seat. Starting at 4 years old, a full fare ticket must be purchased.

15.- Pets can be carried for free as long as the occupancy of the trains does not change this condition and the conditions established in this text are met. Dogs must wear a muzzle and must be leashed from the moment they enter FGC premises. Small animals must travel in baskets or cages, but under no circumstances can they occupy a seat. It is the responsibility of the pet owner to comply with all obligations arising from pet ownership, in accordance with Law 7/2023, of March 28, on animal welfare. 

Dogs considered potentially dangerous by Law 10/1999, of July 30, cannot be led in any case by minors under 16, neither on trains nor in stations (DOGC no. 2948, of 09/08/1999). In accordance with Decree 170/2002 and Royal Decree 287/2002, the person carrying them must have the license and the certification proving registration in the Municipal Register, the leash must be less than 2 meters, and no more than one dog can be led per person, without prejudice to compliance with other obligations provided for in the applicable regulations. 

Guide dogs have a differentiated consideration and are not subject to occupancy conditions.

16.- Access to electric scooters and unicycles is prohibited on the vehicles and facilities of the Rack Railway and the Funiculars; bicycles can be carried for free on all rack railways every day and must be placed in the designated spaces within the vehicle. Depending on train occupancy, authorized FGC personnel can change these conditions.

Given the prohibition of cycling on the paths of the Montserrat Natural Park, access to the Funiculars with these vehicles is not allowed.

17.- Users traveling with luggage will use the luggage tray for small packages and keep the aisles and platforms of the cars clear.

18.- Under no circumstances can FGC be held responsible or be obligated by the advertising disseminated by external companies on trains, stations, tickets, or vending machines.

19.- It is necessary to respect and, where applicable, yield reserved seats to persons with reduced mobility or other groups specified in the signage.

20.- The use of elevators will always take precedence for persons with reduced mobility over personal mobility vehicles.

21.- FGC is a space where coexistence is encouraged. Therefore, users must maintain a civic, correct, and respectful behavior towards other passengers and FGC personnel, and must follow the instructions of FGC staff, signs, auditory signals on trains, funiculars, and stations, as well as public address announcements. FGC is a smoke-free space. 

For this purpose, it is strictly PROHIBITED to: 

a) Smoke on trains, funiculars, and all FGC facilities, whether open or closed, in accordance with Law 20/1985, of July 25, modified by Law 10/1991, of May 10, Law 28/2005, of December 26, and Law 4/2006, of March 31, railway; 

b) Access and circulate with electric scooters and unicycles on FGC vehicles and facilities; 

c) Move with bicycles and other personal mobility vehicles (except wheelchairs) on FGC trains and facilities; 

d) Tie personal mobility vehicles to trees, signs, benches, and other furniture elements or in places reserved for people with reduced mobility; 

e) Use emergency and assistance points without justified cause or misuse them; 

f) Enter or exit the train after the acoustic signal has sounded; 

g) Introduce objects or materials that may be dangerous or annoying to users; 

h) Use emergency stop systems on escalators and elevators without justified cause, and misuse these elements;

i) Travel in places other than those designated for users or under inappropriate conditions; enter driver's cabins or facilities reserved for the exclusive use of the operating company's personnel or authorized personnel; go down to the tracks or enter tunnels; 

j) Prevent or force the opening or closing of access doors to trains and funiculars or manipulate mechanisms intended solely for company personnel, such as forcing or preventing the operation of train steps, etc.; 

k) Use train alarm devices without justified cause or prevent their legitimate use; 

l) Perform activities or actions that may disrupt passage, alter public order, or disrupt the services of the operating company; maintain behavior that poses a danger to one's own physical integrity or to other passengers, and carry out actions that damage or dirty trains or facilities, such as soiling with food or drink remnants, etc.; 

m) Remain in the facilities outside the scheduled hours for passenger use; 

n) Manipulate, destroy, or damage any element related to circulation; 

o) Manipulate, destroy, or damage any fixed or mobile work or installation or any element of the service; 

p) Throw or deposit objects on the track or in its surroundings; 

q) Carry out any other action that may pose a danger to the safety of the railway, the public, personnel, or facilities; 

r) Enter the railway tracks or walk on them, unless expressly authorized; 

s) Use evacuation routes and/or emergency exits without justification or obstruct them; 

t) Carry out activities or actions that may disturb the rest of the users or alter public order (putting feet on seats, stretching out on bench seats, going without shoes or removing them, going naked or shirtless, singing, shouting continuously, using electronic sound equipment without headphones or with headphones but at a volume that bothers other passengers, etc.); 

u) Distribute propaganda, put up posters, beg, organize raffles or gambling games, sell or offer goods or services, or carry out any type of artistic activity on trains and facilities without the company's authorization, such as using musical instruments, etc.; 

v) Consume alcoholic beverages (except in authorized establishments) and toxic substances throughout the FGC area.

Failure to comply with these prohibitions constitutes an offense under Law 4/2006, of March 31, railway, which can be sanctioned as a minor offense with a fine of up to 6,000 euros; if it is serious, up to 30,000 euros; and if it is very serious, up to 300,000 euros. 

Non-compliance with the prohibition provided for in section 16 and 21 b) and c) of these conditions of use in the scope of FGC funiculars is considered a minor offense, in accordance with article 41.a of Law 12/2002, of June 14, on cable transport, which can be sanctioned with a fine of up to 600 euros.
